Welcome to OctoServe. By accessing or using the OctoServe mobile application, website, or services, you agree to be bound by these Terms & Conditions. Please read them carefully.

1. Introduction & Acceptance

OctoServe (“we,” “our,” “us”) provides an integrated platform for rides, logistics, food delivery, shopping, tours, events, and vendor services. By registering, downloading, or using OctoServe, you accept these Terms & Conditions and our Privacy Policy.

2. Eligibility & Registration

• You must be at least 18 years old to register.
• You are responsible for maintaining the confidentiality of your account credentials.
• Providing false or misleading information will result in suspension or termination.

3. Services Provided

OctoServe offers:

• Ride-hailing and transport services.
• Logistics and last-mile delivery.
• Food ordering and delivery.
• Online shopping and vendor marketplace.
• Event and tour discovery.

4. Vendor Terms

• Vendors agree to an 8% commission on every completed sale via OctoServe.
• OctoServe shall remit vendor payments within 48 hours, unless delayed due to circumstances beyond our control (e.g., bank issues, force majeure).
• Vendors must ensure product/service quality, accurate pricing, and compliance with local regulations.
• OctoServe reserves the right to suspend vendors engaging in fraudulent, harmful, or illegal activities.

5. Rider & Driver Terms

• Riders and drivers must pass background checks and maintain required licenses and permits.
• Drivers/riders must ensure safety, timeliness, and professionalism during service.
• OctoServe is not responsible for accidents, losses, or damages caused by drivers or riders, except where legally required.

6. Payments, Fees & Commissions

• Users agree to pay applicable fees displayed at the time of transaction.
• OctoServe’s standard commission is averagely 8% per transaction, although it can go up to 15% as market need demands.
• Payments are processed securely through approved channels.

7. Refunds & Cancellations

• Refunds are processed only in cases of service failure directly attributable to OctoServe.
• Cancellations may attract penalties for users, riders, or vendors, depending on timing and reason.

8. User Responsibilities & Prohibited Conduct

You agree not to:

• Misuse the platform for fraudulent, illegal, or harmful activities.
• Interfere with the app’s operation or misuse intellectual property.
• Harass, abuse, or harm OctoServe staff, vendors, riders, or drivers.

9. Intellectual Property

All content, logos, and technology on OctoServe are the exclusive property of OctoServe. Unauthorized use is prohibited.

10. Limitation of Liability

• OctoServe is not liable for indirect, incidental, or consequential damages.
• Our maximum liability in any claim shall not exceed the value of the affected transaction.

11. Termination & Suspension

We may suspend or terminate accounts violating these Terms, engaging in fraud, or harming OctoServe’s reputation.

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Federal Republic of Nigeria. Disputes shall be subject to the jurisdiction of the courts of Enugu State, Nigeria if no resolutions are reached outside of the courts.
